CONSTRUCTION TERMS & CONDITIONS
Last updated: 26 October 2026
These Construction Terms & Conditions apply to construction, renovation, decking, maintenance and related building services undertaken by Kingdom Construction (“the Contractor”) for its clients (“the Client”).
These terms must be read together with the quotation, project specifications and any written construction agreement accepted by both parties.
1. ACCEPTANCE OF TERMS
1.1. The Contractor will provide a quotation describing the proposed work, pricing and any relevant conditions.
1.2. Before work commences, the Client should review and accept the quotation and any applicable project agreement in writing.
1.3. Acceptance may be recorded through a signed quotation, signed agreement or another written method agreed by both parties.
1.4. The quotation and any project-specific agreement will identify the agreed scope of work, pricing, payment arrangements and other material conditions.
1.5. Where these terms conflict with a specific provision in a signed project agreement, the parties must interpret the documents together. The agreed project-specific provision will take precedence to the extent of the conflict, subject to applicable law.
1.6. Nothing in these terms is intended to remove or restrict any consumer right or statutory protection that cannot lawfully be excluded.
2. QUOTATIONS AND PRICING
2.1. Quotations are prepared using the information, measurements, specifications and site conditions reasonably available when the quotation is issued.
2.2. Unless a different validity period is specified, the quotation will remain valid for 30 calendar days from its date of issue.
2.3. A quotation will identify whether the price is fixed, estimated, provisional or calculated on a time-and-materials basis.
2.4. Unless expressly included, quotations exclude work, materials, services, fees and expenses not specifically described in the agreed scope.
2.5. Where applicable, quotations will identify whether prices include VAT. VAT will be charged where legally applicable.
2.6. The Contractor will inform the Client of material pricing changes arising before acceptance, including changes in supplier prices or material availability.
2.7. No material change to the agreed contract price will be made without an agreed contractual basis or the Client’s approval, except where otherwise permitted by law.
3. SCOPE OF WORK
3.1. The Contractor will carry out the work described in the accepted quotation, plans, specifications and written project agreement.
3.2. The scope of work may include construction, timber decking, renovations, repairs, alterations, installations and other agreed building services.
3.3. Work not expressly included in the agreed scope will be treated as additional work and handled in accordance with Section 7.
3.4. The Client is responsible for reviewing the quotation and raising any omissions, misunderstandings or specification concerns before accepting it.
3.5. The Contractor will not knowingly substitute a materially different product, finish or specification without obtaining any approval required by the agreement or applicable law.
4. DEPOSITS AND PAYMENT TERMS
4.1. The deposit, payment schedule and payment due dates will be specified in the accepted quotation or project agreement.
4.2. Where a deposit is required, the agreed amount and purpose of the deposit will be communicated to the Client before acceptance.
4.3. Deposits may be used for agreed project expenses, including materials, supplier orders, project preparation and mobilisation, in accordance with the project agreement and applicable law.
4.4. Progress payments, where applicable, will be linked to the milestones or stages described in the agreed payment schedule.
4.5. The Client must make payments by the agreed due dates using the payment method specified by the Contractor.
4.6. Any invoice or payment request should identify the amount due and the relevant project or payment milestone.
4.7. If the Client disputes an invoice, the Client should notify the Contractor promptly in writing and explain the basis of the dispute. The parties should attempt to resolve the dispute in good faith.
4.8. Where a payment is overdue, the Contractor may give written notice requesting payment and, where permitted by the agreement and applicable law, suspend affected work after providing any required notice.
4.9. Any interest, collection costs or other charges arising from overdue payments must have a lawful basis and be applied only to the extent permitted by the agreement and applicable law.
4.10. Final payment arrangements and any agreed retention amount must be stated in the project agreement. The Contractor will not impose undisclosed payment conditions after the agreement has been accepted.
5. COMMENCEMENT AND COMPLETION
5.1. The anticipated start date and estimated completion period will be stated in the quotation or project agreement where reasonably possible.
5.2. The commencement date may depend on factors such as receipt of agreed initial payments, material availability, access to the property, required approvals and completion of necessary preparations.
5.3. Estimated completion dates are based on the circumstances reasonably anticipated when the project is planned.
5.4. If a material delay becomes apparent, the Contractor will inform the Client within a reasonable time and explain the known cause and likely effect on the schedule.
5.5. Where a delay affects the agreed completion date, the parties should document any revised schedule or other agreed arrangements.
5.6. Nothing in this section removes any statutory rights the Client may have where work is unreasonably delayed or not performed in accordance with the agreement.
6. SITE ACCESS AND CLIENT RESPONSIBILITIES
6.1. The Client must provide reasonable access to the work area at the agreed times.
6.2. The Client must disclose any known site hazards, concealed services, structural concerns or other relevant information that could affect the work.
6.3. The Client must communicate any necessary decisions, selections and approvals within the agreed timeframes.
6.4. Where the Client is responsible for obtaining plans, permissions, approvals or other documentation, those responsibilities should be specified in the project agreement.
6.5. The Contractor and Client will agree on arrangements for access, working hours, storage of materials, utilities and any facilities required for the project.
6.6. The Client should remove or protect personal belongings in or near the work area where reasonably necessary.
6.7. If the Client’s failure to provide agreed access, information, decisions or approvals materially affects the project, the parties will discuss the resulting costs and schedule implications. Any additional charges must have an agreed or otherwise lawful basis.
7. VARIATIONS AND ADDITIONAL WORK
7.1. A variation is any agreed change to the original scope, specifications, materials, design, quantities or method of work.
7.2. The Client should request variations in writing wherever reasonably possible.
7.3. Before undertaking a variation, the Contractor will communicate its material implications, including any additional cost, credit, payment requirement or effect on the completion date.
7.4. The variation should be approved in writing by both parties before the additional work proceeds, except where urgent action is reasonably necessary to address an immediate safety risk or prevent further damage.
7.5. Where urgent work must be undertaken, the Contractor will communicate the circumstances and reasonably foreseeable costs to the Client as soon as practicable.
7.6. The Contractor is not required to undertake work outside the agreed scope unless the parties have agreed to it or another lawful basis applies.
7.7. An instruction given verbally should be confirmed in writing where it changes the agreed scope or price.
8. MATERIALS AND SUPPLIERS
8.1. Materials will be selected according to the accepted quotation and project specifications.
8.2. The availability, delivery dates and prices of materials may be affected by suppliers and other circumstances beyond the Contractor’s reasonable control.
8.3. If a specified product becomes unavailable, the Contractor will discuss suitable alternatives with the Client before making a material substitution.
8.4. Any approved alternative should be documented, including any price difference or change to the project schedule.
8.5. Where materials are supplied or selected directly by the Client, the parties should agree in advance who is responsible for ordering, delivery, suitability, storage and installation.
8.6. Delays or defects attributable to Client-supplied materials may affect the project, but any resulting responsibility or additional charges will be assessed according to the circumstances, the agreement and applicable law.
8.7. Ownership of materials, responsibility for loss or damage, and any risk associated with stored materials will be governed by the project agreement and applicable law.

9.2. Examples include concealed water damage, rotten timber, unstable foundations, hidden pipes or cables, structural deterioration, unsuitable ground conditions and previously concealed defective work.
9.3. If an unforeseen condition materially affects the scope, cost, safety or timing of the project, the Contractor will inform the Client as soon as reasonably practicable.
9.4. The Contractor will explain the proposed response and any reasonably foreseeable additional costs before proceeding with non-urgent additional work.
9.5. If immediate action is reasonably necessary to address a safety risk or prevent further damage, the Contractor may take proportionate protective steps and notify the Client as soon as practicable.
9.6. Any additional work and associated costs will be handled in accordance with the variation procedure and applicable law.
10. WEATHER AND EXTERNAL DELAYS

10.3. Delays may also arise from material shortages, supplier failures, transport disruptions, authority approvals or other circumstances outside the Contractor’s reasonable control.
10.4. The Contractor will take reasonable steps to minimise avoidable delays and communicate material changes to the schedule.
10.5. Any extension of time or additional cost must be assessed in the circumstances and dealt with under the project agreement and applicable law. This section does not automatically excuse every delay or failure to perform.
